Privacy Statement

1. TRAVEL ABOUT PTY. LTD. <TA> or associated persons or entities is a Booking Service only and gives notice that it acts only as agent for the accommodation owner or other service provider <the SERVICE PROVIDER> for the purpose of booking accommodation and any other services requested of it.
   The SERVICE PROVIDER is the party providing the service or services and associated matters <the SERVICE> and the party with whom the client and all members of his or her family and any other persons accompanying him or her <the CLIENT> has the agreement <the AGREEMENT> for the provision of the SERVICE.
   The person making the request of TA for the booking of a service or services or associated matters acknowledges in doing so that they are over the age of eighteen <18> years and that they act for the CLIENT.
   The CLIENT acknowledges that any dispute in relation to the service at all times remains a matter to be resolved between the CLIENT and the SERVICE PROVIDER.

2. Except as otherwise expressly provided in the AGREEMENT neither TA or associated persons or entities shall be subject to any condition or warranty whatsoever in connection with the AGREEMENT imposed by any applicable Statute or Law whatsoever AND not with standing anything in the AGREEMENT to the contrary, neither TA or associated persons or entities shall be liable for any indirect special or consequential damages resulting from a breach of any condition or warranty whatsoever.

3. The total liability of TA and associated persons or entities for any breach of the AGREEMENT or any other matter for which liability is not validly excluded under the AGREEMENT, is limited to an amount equivalent to any amount received by TA or associated persons or entities for the provision of its or their services.

4. The AGREEMENT shall not exclude or vary any condition or warranty whatsoever imposed by any applicable Statute or Law whatsoever to the extent to which such condition or warranty cannot lawfully be excluded or varied.

5. To the fullest extent possible clients of TA waive any possible rights they may have against TA and associated persons or entities in respect of Part V of the Trade Practices Act 1974 or Part 5 of the Fair Trading Act 1987 or legislation which is similar to Part V or Part 5 or such legislation concerning anything the subject of or incidental to the AGREEMENT AND releases and indemnifies to the fullest extent possible TA and associated persons or entities from any claims arising out of any such right of any other person or entity.

6. If any condition or warranty is implied in the AGREEMENT pursuant to Division 2 of Part V of the Trade Practices Act 1974 or other Statute and has not been excluded from the AGREEMENT, then to the extent to which any such condition or warranty is binding on TA, the liability of TA or associated persons or entities for breach of the condition or warranty shall be limited by TA in its discretion in the case of services to:
     a)  The supplying of the services again;  or
     b)  The payment of the costs of having the services supplied again.

7. The contents of this document and other relevant documentation are based on information received by TA. Although that information is believed to have been correct at the time of publication neither TA, nor associated persons or entities accept responsibility nor give any warranty for its accuracy. Information which is correct at the time of publication may subsequently become the subject of material alteration without notice.

8. SECURITY DEPOSIT <CAUTION>. The CAUTION is the amount required to be paid to the SERVICE PROVIDER or their agent prior to the provision of the SERVICE. The CAUTION will be refunded at the conclusion of the provision of the SERVICE subject to deduction for any damage, breakage, cleaning, subsidiary costs or any monies in any way owing to the SERVICE PROVIDER by the client.

9. CLIENT RESPONSIBILITIES The CLIENT when occupying a property or coming to or from such property must not cause nuisance or annoyance to the SERVICE PROVIDER or their neighbours and the CLIENT must use and maintain the property carefully and leave it clean and tidy and under no circumstances shall any party other than the CLIENT benefit from the property or from the provision of the SERVICE and under no circumstances, without the prior consent of the SERVICE PROVIDER or their agent, shall the number of persons occupying the property exceed the number notified to TA. Any breach of this condition will lead to the CLIENT being required to immediately vacate the property without any refund of any amount paid by the CLIENT for the provision of the SERVICE.

10. ELECTRICITY & HEATING Unless otherwise indicated the cost of electricity and heating, other than for any daily allowance notified to the CLIENT, is the responsibility of the CLIENT and must be paid for by the CLIENT to the SERVICE PROVIDER or their agent, based on meter readings on arrival and departure, or as otherwise agreed between the SERVICE PROVIDER or their agent and the CLIENT.

11. ANIMALS Unless otherwise agreed with the SERVICE PROVIDER, prior to arrival, animals are not under any circumstances permitted in the property.

12. INVENTORY An inventory may be made by the SERVICE PROVIDER or their agent of the contents of the property and such inventory may be checked by the SERVICE PROVIDER or their agent on the day of arrival and of departure.

13. CANCELLATION COSTS Deposits and all other payments for the provision of the SERVICE, once made, are non refundable. The CLIENT is strongly advised to take out Travel Insurance that includes cancellation costs.

14. EXCLUSION OF LIABILITY Neither the SERVICE PROVIDER or their agent nor TA or associated persons or entities accept any responsibility whatsoever for any accident, injury or losses of any kind whatsoever occasioned by the CLIENT occurring within the boundaries of the property and or its grounds, or elsewhere, or in the use of any facilities or equipment or swimming pool. The CLIENT in booking the SERVICE specifically acknowledges this exclusion of liability and further acknowledges that the use of the property, its grounds and all equipment and facilities is entirely at the risk of the CLIENT.
